It is stated in the fact sheet that â€Å"GINA expands the genetic information protections included in the Health Insurance Portability and Accountability Act of 1996 (HIPAA). HIPAA prevents a plan or issuer from imposing a preexisting condition exclusion provision based solely on genetic information, and prohibits discrimination in individual eligibility, benefits, or premiums based on any health factor (including genetic information)† (United States Department of Labor, 2009). Surveys was taken from 50 states that relied on the Bureau of Labor Statistics. These surveys showed disparities in private sector leave and  gender differences. Arguments are made over the distinction based on the level of scrutiny (Tobin, 2008). GINA was first introduced in 1995 in response to concerns about the misuse of information regarding genetic predispositions to various diseases. The bill sought to help those that was applying for insurance to keep them from being denied. According to GINA the analysis went wrong in some aspect of employment. The Supreme Court’s Section 5 jurisprudence insofar as they provide remedies for state employees (Tobin, 2008). It is also unlawful for a covered entity to disclose genetic information about applicants, employees or members. Covered entities must keep genetic information confidential and in a separate medical file (Tobin, 2008). There are limited exceptions to this non-disclosure rule, such as exceptions that provide for the disclosure of relevant genetic information to government officials investigating compliance with Title II of GINA and for disclosures made pursuant to a court order (Tobin, 2008). When it comes down to any type of employment the law forbids discrimination on the basis of genetic information which include hiring, firing, pay, job assignments, promotions, layoffs, training, fringe benefits, or any other type of employment. An employer should never use genetic information to make an employment decision because genetic information is not relevant to an individual’s ability to work at any time (Tobin, 2008). A goal of the policy is to protect equality and privacy of an employer that lose their jobs as a result to genetic testing. According to Kimel and Garrett evidence that Congress collected is of no concern because it’s only in the private sector and not by state. Some states argued that being flexible to GINA is not consistent with the Court’s (Tobin, 2008). Instances in these cases shows the analysis of the areas that are considered too went wrong with GINA. For instance, courts need to apply heightened constitutional scrutiny to genetic discrimination. This will keep states from arguing against them and win stating its insufficient data. Another examples is there is a strong case for abrogating sovereign immunity in those cases where employers rely on the information that is took from genetic testing that has been linked to racial or ethnic backgrounds. The last reason is the provisions that uphold GINA’S privacy in 5 legislations has an uncertainty about it not being strong enough to work against state  employment. The Voting Rights Act Reauthorization Act was created in 2006 to place jurisdictions on the voting history of racial discrimination. The research from this act allowed congress to take action towards making decisions on these issues. Approval would have to come from the attorney General or a federal court. This pro vision help minority voters the ability to vote and make their voice heard through the election process (Tobin, 2008). Another concern was about racial profiling policies and procedures that needed to be changed to prohibit police from unjustly stereotyping individuals (Tobin, 2008). This bill called End Racial Profiling Act was entered into the legislations by Rep. John Conyers and Sen. Russ Feingold in 2001. The courts shouldn’t have invalidated the civil rights as it did because it didn’t put enough force on change for minorities. It has hesitantly enforced the rights of persecuted minorities and in many ways it has changed the face of the United States law and politics. I determined that GINA has been cited as a strong step forward, but I believe that the legislation does not go far enough in enabling personal control over genetic testing results. In conclusion, these cases have changed the livelihood of many people but more need to be done for better congressional. Robinson Crusoe Essays - English-language Films, British Films Robinson Crusoe Robinson Crusoe was written by Daniel Defoe. The novel was first published in 1719. It tells the story of a young explorer who becomes marooned on a deserted island. His experiences of the island change his outlook on life. Daniel Defoe was a short story writer that came from an poor family. Defoe was poor for most of his life and made his living as a butcher and a writer. Defoe mostly wrote short stories and political essays. Robinson Crusoe was a combination of two short stories. Many believe Defoe used Robinson Crusoe to portray himself in a certain ways. The description was almost identical to his own and after his wife left him, he felt as if he was marooned on a deserted island. The story takes place in the 1700s on a deserted island somewhere off the coast of Brazil. The island is fairly large in size and has a small shore. The interior of the island has many trees, wild pigs and other small animals and a small cave in which Crusoe stores food. I walked about the shore lifting up my hands. Look around, I see nothing but water, a forest, and the remains of my ship. At first, I was afraid of wild animals but after some exploration of the land, the only animals I had seen were wild pigs, squirrels, and some small birds. The only possessions that Crusoe retrieved from the remains of his ship were a small knife, a box of tabacco, a pipe, and a small book that would later become his journal. Robinson Crusoe was a young and stubborn explorer. He was extremely tall and strong. His stay on the island changed him from a mean, stubborn man to an open-minded protestant. Standing at six feet, two inches and having my long, thick brown hair back in a ponytail, I felt as if I was eight feet tall. Without the permission of my parents, I was still sailing away from the misery. I held the cargo box is my strong arms, waiting to board my beautiful ship. Crusoe became a skilled craftsman and was an extremely religious man due to his stay on the island. Being the only man on the entire island, he established a faith in God. He also became more articulate from writing in a journal daily. Overall, his stay on the island changed Crusoe's life greatly. As the story begins, Robinson Crusoe defies his parents and sets out to sea. Crusoe encounters a series of violent storms at sea and ends up in Africa. He sets out on another voyage and is captured by the Sallee, a group of pirates. Luckily, he manages to escape and board a Portuguese ship and sail to Brazil. While in Brazil, Crusoe purchases a large sugar plantation. After leaving Brazil, he encounters another storm in which his ship is destroyed and he is marooned on an island as the only survivor. On the island, Crusoe gathers food and builds a small shelter. He writes in a journal to keep account of his stay. Crusoe becomes a skilled craftsman and begins to feel a spiritual connection with God. He also builds a small boat that he uses to sail around the island. After living on the island for fifteen years, Crusoe discovers that savages had landed on the island and that they perform human sacrifices. Crusoe helps a prisoner escape from these savages. He names the prisoner Friday and teaches him english. Together, they build a new boat and attempt to leave the island. However, Friday learns his father is a prisoner of the savages. Crusoe and Friday return and rescue his father and a Spaniard. The four men board a passing boat and gain control of it. Crusoe sails back to his native land to learn his sugar plantation has made him rich. He sells the plantation and marries. As the novel closes, Crusoe is persuaded to take a final voyage, back to the island. Robinson Crusoe is written using an English dialect. The narration of the novel is simple, informal and extremely easy to understand. However, Defoe uses verbose descriptions for characters. He was a comely, handsome fellow, perfectly well made, with strong limbs, not too large, tall and well-shaped, and I reckon he was about twenty years of age. The Difference Between Sea Lions and Seals The term seal is often used to refer to both seals and sea lions, but there are several characteristics that set seals and sea lions apart. Below you can learn about the differences that set seals and sea lions.   Seals, sea lions, and walruses are all in the order Carnivora and suborder Pinnipedia, thus they are called â€Å"pinnipeds.† Pinnipeds are mammals that are well-adapted for swimming. They usually have a streamlined barrel shape and four flippers at the end of each limb.  As mammals, they also give birth to live young and nurse their young. Pinnipeds are insulated with blubber and fur.   Pinniped Families There are three families of pinnipeds: the Phocidae, the earless or true seals; the Otariidae, the eared seals, and the Odobenidae, the walrus. This article focuses on the difference between the earless seals (seals) and the eared seals (sea lions). Characteristics of Phocidae (Earless or True Seals) Earless seals have no visible ear flaps, although they still have ears, which may be visible as a dark spot or small hole on the side of their head.   True seals: Have no external ear flaps.Swim with their hind flippers. Their hind flippers always face backward and are furred.Have front flippers that are short, furry and stubby in appearance.Have two or four teats.Can be found in both marine and freshwater environments. Unlike earless seals, their hind flippers can turn forward, and they are better able to walk, and even run, on their flippers. The seals you may see performing at marine parks are often sea lions.May congregate in larger groups than true seals. Sea lions are much more vocal than true  seals, and make a variety of loud, barking noises. Examples of eared seals: Steller’s sea lion (​Eumetopias jubatus), California sea lion (Zalophus californianus), and Northern fur seal (Callorhinus ursinus). Characteristics of Walruses Wondering about walruses, and how they differ from seals and sea lions? Walruses are pinnipeds, but they are in the family, Odobenidae. One obvious difference between walruses, seals and sea lions is that walruses are the only pinnipeds with tusks. These tusks are  present in both males and females. Other than tusks, walruses have some similarities to both seals and sea lions. Like true seals, walruses dont have visible ear flaps. If you want to pursue a specific major, you can learn about its course requirements, professors, and any special programs for students in that major. Use the school's website, college finders, search websites, and guidebooks to help you learn about the school. Your research will help you prepare for questions you may be asked, and it will help you come up with questions for your interviewer. Step 2: Prepare for Your InterviewAnswer Check out this article for a specific guide on the questions you should prepare for. Some common ones include: Why are you interested in this college? Working in groups generates work relationships among individuals who get tied to one another with personal and social ties, which makes them an informal organization. An informal organization consists of relationships that emerge and persist as a result of workers existing in the same workplace and having common objectives and similar problems. An informal organization emerges as a result of a formal organization because it is the latter that gathers workers in the same place to perform certain duties and reach specified objectives. Besides, it represents the formal centers, relations and channels of communication between the workers and the rules that govern their behaviors and relations. Basic elements of the group Work teams and informal organization are based on the following elements: Relations among members: This consists of the daily dealings between individuals regarding their work and personal aspects. Behavioral rules There are certain behavioral rules dictated by the group upon its members such as helping one another, correcting someone when he makes an error. There are a lot of rules that have to be observed by group members. Feelings Some feelings arise among group members as a result of their daily encounters and continuous relations. Group Theory Elements and Dynamics According to Johnson Johnson there are five major elements that must be present for a group to successfully reach a goal. The five elements are positive interdependence, individual accountability, primitive interaction, appropriate use of social skills, and group processing. One of the factors established in group dynamics is that to have a group, two or more must be present and in like mindset of achieving a common goal. For this goal to be achieved certain skills must be present for a successful outcome.   The skills required to have a successful group, and  certainly to have a successful outcome, involve every group member and certainly his or her participation and commitment. As listed by the authors one of the elements, positive interdependence of group members is necessary to have a successful group. This particular element ensures that one member cannot succeed without coordinating his or her efforts with all the other group members to complete the task. This specific element also helps to eliminate diffusion of group responsibility. Each group member must partake equally and effectively in achieving the set goal so all members must have the same set of motivational factors. First and foremost to be successful the group must achieve its goals, maintain a good working relationship among its members, and lastly be able to adapt to the changing conditions it meets during the process of accomplishing the goal (Johnson Johnson, 2000 P. 12).   Clear, relevant and concise goals must be established and agreed upon by group members as such that a high level of commitment is evoked insuring completion of every group members interdependent contribution to the goal. Two-way communication is paramount for the group to be a success and all members should be aware that each and every one is to assume and participate in the role of leader. There should be a balance in power and decision-making, usually the preferred method being by consensus. According to Johnson and Johnson controversies are certainly going to arise in the group process. When this occurs group members should challenge conclusions and reasoning, resulting in creative decision-making and problem solving. This particular group dynamic presents an opportunity for growth for the group members. Group members should face conflicts which will be promoted by incompatibilities and engage in problem-solving negotiations to resolve such conflicts. Several strategies can be use d including withdrawal, forcing, smoothing, compromising and problem solving. Conflicts arising are an important factor and tend to increase group effectiveness (Johnson Johnson, 2000).   The importance of team work Teamwork is important for an endless amount of reasons. There are so many things that are virtually impossible to take on without the use of a team that knows how to work together. The importance of teamwork is something that should be touched on during team building events. If this concept is not understood and carried out at work, your team will not be running as a solid unit. Understanding your team and the many facets of it is just the beginning. The main reason to form a team is to accomplish something intense that cannot easily be achieved by just one person. People need to rely on each other sometimes and understanding that is the start to a potentially great working relationship. When we all come together with one specific shared goal, success is that much easier to obtain. Its also much more efficient and effective than trying to tackle a huge challenge by one member. Nothing great was ever achieved by one person alone. It took many to build the pyramids so why should it take only one to build your ideal business? Understand that you can only benefit from working as a team. Compromise is the secret weapon of strong team that knows where their priorities lie. Nobody can be right all the time. At age six(two years after his father passed away)Nietzsche, his mother and sister moved to the small town of Naumburg. When Nietzsche was twelve he wrote â€Å"I saw God in all his glory†(Bentley, p.82). Later his description of his own mental state was one of Gottergebenheit; â€Å" surrender to God†(Bentley, p.82). At a very early age Nietzsche had already displayed an aptitude for highly intellectual prowess. At fourteen, Nietzsche left his home of Naumburg and went to an exclusive boarding school at the nearby Schulpforta Academy. The school was famous for its grandeur of alumni that included â€Å"Klopstock and Fichte†(Brett-Evans, p.76). â€Å"It was here that Nietzsche received the thorough education in Greek and Latin that set him upon the road to classical philology.†(Brett-Evans, p. 76) On many occasions Nietzsche's zeal to prove himself at the Pforta school spurned legendary tales. One certain tale is when Nietzsche â€Å"could not bear to hear of the courage of Mucius Scaevol, who did not flinch when his hand was burnt off, without seizing a box of matches and firing them against his own hand.†(Bentley, p.84) At the age of twenty, Nietzsche left to attend Bonn University. By this time Nietzsche had come to think of himself as an â€Å"aristocrat whose great virtues are fearlessness and willingness to assume leadership.†(Bentley, p.85) Ironically, Nietzsche planned to study theology(to please his mother). At this time Nietzsche no longer believed in Christianity, because â€Å"with maturity he lost his heavenly father†(Bentley, p.86). In 1868 Nietzsche was a student in Leipzig. This is when he met Cosima and Richard Wagner. The... ...world domination is only possible by ignoring the greater part of what he wrote.†(Brett-Evans, p.81) Matter-of-factly, Nietzsche sternly despised anti-Semites. At certain times, there was not a harsher critic of racist German nationlism. But some questions arise out of these statements. What of the comments Nietzsche made concerning the â€Å"will-to-power† theory, the constant reference to the â€Å"superman†, and his sometimes vigorous patriotism? One of the most significant contributions Nietzsche made was in the area of psychology not philosophy. One of the â€Å"most significant conclusions he came to in this field was that traditional morality consists of different expressions for the same thing, that "good" actions and "bad" actions can ultimately derive from the same motive.†(Brett-Evans, p.80) In truth I believe that Friedrich Nietzsche was a visionary who was never able to replace his earthly Father or his heavenly Father. This led to his strange emotional relationship with women. His only friends were those women who he had failed relationships with and men who he quarreled with. In the end, Nietzsche died of syphilis that was allegedly contracted while in college.
